1. Agreement
These Terms govern access to and use of Konekt, a web-based customer-service platform operated by Ævar Bernburg Kristjánsson in Iceland.
By creating an account or using Konekt, you agree to these Terms. If you use Konekt for an organization, you confirm that you are authorized to accept these Terms on its behalf.
2. The Service
Konekt provides tools to help businesses manage customer communications. Features may include website live chat, email support, AI-assisted chatbots, ticketing, social media messaging integrations, conversation summaries, suggested replies, classifications, and reporting.
Available features may depend on the subscription, configuration, and integrations selected.
3. Accounts and Security
You must provide accurate account information and keep it reasonably up to date. You are responsible for protecting your credentials, controlling account access, assigning appropriate agent permissions, and reporting suspected unauthorized access.
You must not share credentials or circumvent security controls in a way that compromises the service.
4. Business Customers and Agents
Business customers are responsible for their agents' use of Konekt and for ensuring that their use complies with applicable laws and third-party terms.
You must have the necessary authority to connect communication channels and process information submitted to the service.
5. Customer Data
You retain the rights you hold in information and content submitted to Konekt (“Customer Data”).
You authorize Konekt to host, transmit, process, and otherwise use Customer Data as necessary to provide, secure, maintain, and support the service in accordance with these Terms, the Privacy Policy, and applicable agreements.
You are responsible for having the rights, permissions, notices, and lawful bases needed to submit Customer Data and authorize its processing.
Where you use Konekt to process personal data about your own customers, you are generally responsible for determining the purposes and lawful basis of that processing and providing appropriate notices. A separate data-processing agreement will apply where required.
6. Acceptable Use
You must not use Konekt to violate laws or third-party rights; send unlawful spam or deceptive communications; distribute malware; access systems or data without authorization; interfere with service security or availability; bypass usage restrictions; or submit information unlawfully.
You must not use Konekt or its AI features for unlawful discrimination, impersonation, fraud, or other prohibited harmful activity.
7. AI Features
Konekt uses the ChatGPT API and Gemini API for AI-assisted customer-service features. Outputs may include suggested replies, summaries, classifications, and chatbot responses.
AI outputs can be inaccurate or incomplete. You are responsible for reviewing outputs where appropriate and deciding whether to use or send them.
You must ensure that your use of AI features complies with applicable law and your obligations to customers.
AI-assisted service delivery is separate from using conversations to train or fine-tune models. Any such training involving personal data must be supported by the applicable legal basis, permissions, disclosures, and contractual arrangements.
8. Third-Party Services
Konekt may integrate with third-party hosting, payment, communication, social media, analytics, and AI services. Those services may have separate terms and privacy policies.
You are responsible for ensuring that you are authorized to connect third-party accounts and comply with applicable third-party requirements.
9. Fees and Billing
Prices, billing intervals, usage limits, taxes, renewals, and payment terms will be stated in the applicable plan or order documentation.
Before publication, specify: subscription prices, billing intervals, trial terms if any, renewal rules, cancellation procedures, refund policy, failed-payment handling, and usage-based charges if applicable.
You agree to pay fees properly due under the plan you select.
10. Availability and Changes
We aim to provide a reliable service but do not guarantee uninterrupted or error-free availability unless expressly agreed in writing.
We may maintain, update, or modify the service. Material changes affecting contractual commitments will be handled in accordance with applicable law and the relevant agreement.
11. Intellectual Property
Konekt and its software, branding, design, and documentation are owned by or licensed to Konekt.
Subject to these Terms and payment of applicable fees, Konekt grants you a limited, non-exclusive, non-transferable right to use the service for its intended purpose during your authorized access period.
You retain your rights in Customer Data, subject to the permissions needed for Konekt to provide the service.
12. Confidentiality
Each party must take reasonable care to protect non-public information received from the other and use it only for the relevant business relationship, subject to applicable law and any separate confidentiality agreement.
13. Suspension and Termination
You may stop using Konekt and cancel your subscription according to the applicable plan or order terms.
We may suspend or restrict access where reasonably necessary to address security risks, unlawful activity, material breaches, non-payment, or risks to the service or other users. Where appropriate and legally permitted, we will provide notice and an opportunity to remedy the issue.
Before publication, specify cancellation procedures, notice periods, termination rights, applicable refunds, and the process for exporting or deleting Customer Data.
After termination, we will handle retained and deleted data in accordance with applicable agreements, our Privacy Policy, and legal obligations.
14. Disclaimers
To the extent permitted by law, Konekt is provided on an “as available” basis. We do not guarantee that it will always be uninterrupted, error-free, or suitable for every purpose.
Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded.
15. Liability
Liability exclusions and limits must comply with applicable law. Nothing in these Terms excludes liability that cannot lawfully be excluded or restricts mandatory consumer rights.
Before publication, insert and legally review the intended liability limits, exceptions, and any service-specific commitments.
16. Changes to These Terms
We may update these Terms to reflect changes to the service or legal requirements. We will notify users of material changes where required. Where express agreement is legally required, continued use alone will not replace that requirement.
17. Governing Law
These Terms are intended to be governed by Icelandic law, subject to mandatory laws and consumer protections that apply to you. Nothing in this section removes rights that cannot lawfully be waived.
